Planned Actions Regarding Protected Wetlands and Covenant Dissolution
- Research of Wetland Maintenance Companies
The first priority will be to research and identify reputable companies capable of maintaining the protected wetlands (open space). This includes verifying their qualifications, experience, and long-term sustainability. - Transfer of Protected Wetlands
Once a suitable company has been identified and approved by the HOA Board, the protected wetlands will be formally donated to that company. This transfer will occur following a full Board review and agreement. - Covenant Dissolution Process
Parallel to the wetlands transfer, the HOA will research the cost and procedural requirements for dissolving the existing covenants. This includes preparing and filing all necessary paperwork with Elbert County. - Allocation of Remaining HOA Funds
Upon determining the cost of covenant dissolution, the HOA Board will evaluate how to allocate any remaining funds in the HOA bank account. Potential uses may include community services such as cleanup dumpsters or other resident-beneficial services. - Execution of Covenant Dissolution
Once the required expenses for wetland transfer and covenant dissolution are covered, the HOA Board will proceed with the formal process of dissolving the covenants. - Contingency for Dissolution Denial
It is important to note that covenant dissolution is subject to approval by Elbert County. If the County does not approve the dissolution, the covenants may remain in effect. In that case, the HOA Board will reconvene to determine appropriate next steps.
